The above-captioned matter was scheduled to be heard as a contested case on October 4, 2007, at which time both the complainants and the respondent appeared. An introductory review of the allegations presented by the complaint and relevant law was conducted on the record. Following this review, the parties agreed to hold an off the record settlement conference without the presence of the hearing officer.
As a result of this conference, the parties announced on the record to the hearing officer their desire to settle this contested case based upon a stipulation that the complainants will pay $50 in order to receive from the respondent the two requested grand lists. Moreover, the respondent agreed to review whether it is able to provide to the complainants data directly from the “tumbleweed program” forwarded to the respondent by the Department of Motor Vehicles. If the respondent is able to do so, it will in the future provide the information in this manner.
Based upon this stipulation, the complainants stated on the record that they wished to withdraw their complaint.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
