The above-captioned matter was scheduled to be heard as a contested case on March 29, 2007, at which time the complainant and the respondent appeared and reached the following settlement of the complaint in this matter.

 

1.  The parties stipulated that one computer disc responsive to the complainant’s November 1, 2006, request for records is corrupted and cannot be opened or copied.

 

2.  With respect to the other five computer discs that are responsive to the complainant’s November 1, 2006 request, the respondent pledged to attempt the following procedure to provide the complainant with copies thereof: 1) for each disc, place the disc in a computer, open the disc, remove the disc from the computer, place a fresh disc into the computer, and hit the copy button; 2) if successful, provide such copies to the complainant at no cost.

 

3.  The parties stipulated that the respondent may redact the following information with respect to the discs at issue: social security number; date of birth; and medical information, except body part.

 

4.  The respondent will also provide the complainant with copies of e-mails corresponding to e-mail attachments already provided to the complainant, although such e-mails only contain the name of the sender, recipient, and date sent.

 

5.  The complainant will pay the State of Connecticut $27.65 for copies of paper records received in response to his November 1, 2006 request.

 

6.  The complainant stated that, if after review of the copies described herein, he is satisfied, he will withdraw the complaint in this matter.  The complainant further stated that, if after review of the copies described herein, he is not satisfied, he will so inform the Commission in writing and request that a continued hearing in this matter be scheduled.

 

As of September 18, 2007, the complainant had not further contacted the Commission with respect to this complaint. 

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is hereby dismissed.

 

2.   The Commission commends the parties on reaching a non-litigated settlement of this matter.
