The above-captioned matter was scheduled to be heard as a contested case on May 24, 2007, at 9:30 a.m., at which time the respondent appeared, however, the complainants failed to appear.  During the time the hearing was to occur, the complainant requested, by telephone, to participate in the hearing via telephone conference.  The hearing officer denied that request.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is hereby dismissed for failure to prosecute.
