The above-captioned matter was scheduled to be heard as a contested case on May 31, 2007, at which time the complainant and the respondent appeared and informed the Commission that they had settled the complaint in this matter.  In consideration of such settlement, the complainant withdrew the complaint.  

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based upon the complainant’s withdrawal, the complaint is hereby dismissed.

 

2.  The Commission commends the parties on reaching a non-litigated settlement of this matter.
