FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was scheduled to be heard as a contested case on March 15, 2007, at which time the complainant and the respondents appeared and jointly requested that the matter be continued so that settlement of the complaint might be attempted.  Such request was granted. 

 

A continued hearing was scheduled for June 5, 2007.  However, by letter filed with the Commission on June 5, 2007, the complainant withdrew the complaint.  Accordingly, the continued hearing was cancelled. 

 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the complaint is hereby dismissed.
