The above-captioned matter was heard as a contested case on November 20, 2006, at which time the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint. 

           

By letter dated February 8, 2007, the complainant reported that the parties had reached a settlement and requested that the complaint in this matter be withdrawn.  The Commission takes administrative notice of such letter.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

  1. Based on the withdrawal of the complaint, the case is hereby dismissed.
