The above-captioned matter was heard as a contested case on January 10, 2006, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  For purposes of hearing, the above-captioned case was consolidated with docket #FIC 2005-511; Don Stacom and the Hartford Courant v. John Divenere, Chief, Police Department, City of Bristol (hereinafter “Docket #FIC 2005-511”).  The Commission takes administrative notice of the testimony, exhibits, and argument presented in the aforementioned docket.  Furthermore, the respondent submitted the records at issue in the above-captioned appeal for in-camera inspection which records are also at issue in docket #FIC 2005-511 and were submitted for in-camera inspection with respect to that case as well.  Richard Valentine and Daniel Britt, the subjects of the records at issue in this matter, were represented by counsel at the hearing in this matter and were granted party status. 

 

After consideration of the entire record, the following facts are found and conclusions of law are reached:

1.      The respondent is a public agency within the meaning of §1-200(1), G.S.

 

2.      It is found that by letter dated September 26, 2005, the complainant made a request for a copy of:

 

a.       “documents created or obtained as a result of an investigation into the operation of a radio station by a member or members of the Bristol Police Department;”

 

b.      “any request to destroy records of the officer [allegedly involved in the operation of the radio station] under the records retention statute;” and

 

c.       “the case name and docket number of any ‘pending litigation’ as defined by the FOIA against the officers [allegedly involved in the operation of the radio station].”

 

3.      It is found that by letter dated October 3, 2005, the complainant made a request to the respondent for a copy of:

 

a.       “the complete personnel files of Officers Richard Valentine and Daniel Britt, which records should include, but are not limited to, any and all complaints and discipline, whether substantiated or not, and any separately maintained internal files related to the performance of the officers’ job;”

 

b.      “any request to destroy the records of the aforementioned officers;” and

 

c.       “ the case name and docket number of any ‘pending litigation’ as defined by the FOIA pertaining to the actions of the aforementioned officers.”

 

4.      It is found that by letter dated October 7, 2005, the respondent, through counsel, informed the complainant that Richard Valentine, and Daniel Britt, objected to the disclosure of their personnel files and that the respondent would not disclose the files until ordered to do so by this Commission. 

 

5.      By letter dated October 12, 2005 and filed on October 21, 2005, the complainant appealed to this Commission alleging that the respondent violated the Freedom of Information (“FOI”) Act by failing to comply with the complainant’s September 26, 2005 request described in paragraph 2, above, and by failing to comply with the complainant’s October 3, 2005 request described in paragraph 3a, above.

 

6.      It is found, however, that after the hearing in this matter the complainant and Richard Valentine reached an agreement with respect to the disclosure of his personnel and internal affairs investigation files, and such records will not be addressed further herein.

 

7.      It is found, therefore, that the only records that remain at issue in this matter are the personnel files of, and internal affairs investigation reports regarding, Daniel Britt, who is a retired law enforcement officer from the city of Bristol’s police department (“hereinafter “BPD”).

 

8.      Section 1-210(a), G.S., provides in relevant part that:

 

[e]xcept as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to . . . receive a copy of such records in accordance with section 1-212. . . .

 

9.      Section 1-212(a), G.S., provides in relevant part that “any person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.” 

 

10.   It is found that the requested records, to the extent such records exist, are public records within the meaning of §1-210(a), G.S.

 

11.   With respect to the complainant’s request described in paragraph 2a, above, it is found that, prior to the hearing in this matter, the respondent provided the complainant with a copy of an investigation report of a radio station allegedly operated by a member or members of the BPD.  It is found that the investigation was conducted by a law firm hired by the city of Bristol, which firm also produced the report.

 

12.   At the hearing on this matter, the complainant indicated that it rejected the investigation report that was provided as not responsive to its request because the investigation was not impartial and lacked credibility since it was paid for by the entity that was being investigated.

 

13.    Notwithstanding the complainant’s lack of confidence in the credibility of the investigation report, it is found that said report is the only record responsive to the complainant’s request described in paragraph 2a, above, maintained by the respondent.  

 

14.   With respect to the complainant’s request described in paragraphs 2b, and 2c, above, it is found that the respondent does not maintain any records responsive to those requests.

 

15.    It is concluded that the respondent did not violate the disclosure provisions of  §§1-210(a) and 1-212(a), G.S., with respect to the complainant’s records request described in paragraph 2, above.

 

16.   With respect to the complainant’s request described in paragraph 3a, above, the respondent submitted the requested records to the Commission for an in-camera inspection, the relevant portions of which have been identified as in-camera record #s 2005-508/511-196 through 2005-508/511-735.

 

17.   With respect to in-camera record #s 2005-508/511-252 through 2005-508/511-287, it is found that such records did not exist at the time of the complainants’ request.  However, the respondent indicated, on the in-camera index submitted with such records, that there is no objection to the disclosure of such records.

 

18.  With respect to the remaining in-camera records, the respondent contends that because Mr. Britt is no longer employed by the BPD, disclosure of the contents of his personnel files and internal affairs investigation reports cannot be a matter of legitimate public concern and the disclosure provisions are overridden by §1-210(b)(2), G.S.  The respondent further contends that the files contain the names of sexual assault victims and juveniles, uncorroborated allegations, records pertaining to pending criminal matters, and medical information.  The respondent also contends that in the event that the Commission determines that not all of the in-camera records are exempt, the respondent should be permitted to redact the aforementioned information pursuant to §§1-210(b)(2), (3), 1-214(a) and (c), and 1-217(2), G.S.

 

19.    Section 1-210(b)(2), G.S., provides in relevant part that nothing in the FOI Act shall require the disclosure of  “personnel or medical files and similar files the disclosure of which would constitute an invasion of personal

privacy. . . .”

 

20.    Section 1-214(b), G.S., provides in relevant part that: 

 

“Whenever a public agency receives a request to inspect or copy records contained in any of its employees’ personnel or medical files and similar files and the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy, the agency shall immediately notify in writing (1) each employee concerned . . . and (2) the collective bargaining representative, if any, of each employee concerned.  Nothing herein shall require an agency to withhold from disclosure the contents of personnel or medical files and similar files when it does not reasonably believe that such disclosure would legally constitute an invasion of personal privacy.”

 

21.      The Supreme Court set forth the test for the §1-210(b)(2), G.S., exemption in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993), which test has been the standard for disclosure of records pursuant to that exemption since 1993.  The Commission takes administrative notice of the multitude of court rulings, Commission final decisions (see Endnotes  A) and instances of advice given by Commission staff members (see Endnotes B) which have relied upon the Perkins test, since its release in 1993.

 

22.    Specifically, under the Perkins test, the claimant must first establish that the files in question are personnel, medical or similar files. Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy. In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that disclosure of such information is highly offensive to a reasonable person.

 

23.    It is found that the in-camera records are “personnel or medical files and similar files” within the meaning of §1-210(b)(2), G.S.

 

24.    The respondent contends that in-camera record #s 2005-508/511-210b, 214b, 227 through 229, 230 through 231b, 299, 306, 388 through 401, and 427-431, contain medical information and are exempt from disclosure pursuant to §1-210(b)(2), G.S.

 

25.    It is found that the in-camera records described in paragraph 24, above, are not “medical files” nor do they contain “medical” information within the meaning of §1-210(b)(2), G.S., and are not exempt from mandatory disclosure pursuant to that provision.

 

26.      Furthermore, with respect to the respondent’s contention that all of the in-camera records are exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S., because the officer is now retired, it is found that the in-camera records include newspaper articles, letters of commendation, promotions, salary increases, orders to attend training, disciplinary and retirement records and the names and addresses of family members.

 

27.    It is found that the respondent failed to prove that the information contained in all of the in-camera records, including those described in paragraph 24, above, except for the names and addresses of family members, do not pertain to legitimate matters of public concern and that disclosure of such records would be highly offensive to a reasonable person.

 

28.   It is found that the names and addresses of family members contained in the in-camera records, do not pertain to legitimate matters of public concern and the disclosure of such information would be highly offensive to a reasonable person.

 

29.   It is concluded, therefore, that the in-camera records, with the exception of the names and addresses of family members, described in paragraph 28, above, are not exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S. 

 

30.   The respondent contends that in-camera record #s 2005-508/511-505 through 506, 552, 556 through 564, 591, 621, 644, 702 through 703, and 708 through 735, are exempt from disclosure pursuant to §§1-210(b)(3)(F) and (G), G.S.

 

31.    Section 1-210(b)(3), G.S., provides in relevant part that nothing in the FOI Act shall require the disclosure of:

 

Records of law enforcement agencies . . . which records were compiled in connection with the detection or investigation of crime, if disclosure of said records would not be in the public interest because it would result in the disclosure of . . .  (F) the name and address of the victim of a sexual assault . . . (G) uncorroborated allegations subject to destruction pursuant to section 1-216.  

 

32.    It is found that the in-camera records described in paragraph 30, above, are records of a law enforcement agency not otherwise available to the public.  

 

33.    It is found, however, that with the exception of in-camera record #s 2005-508/511-556 through 564, the in-camera records described in paragraph 30, above, were not compiled in connection with the detection or investigation of crime, but rather are administrative and personnel records including letters of commendation, letters of reprimand, or internal investigations, which were non-criminal police internal affairs investigations and the administrative disposition of such investigations.

 

34.    It is concluded, therefore, that the in-camera records described in paragraph 30, above, with the exception of in-camera record #s 2005-508/511-556 through 564, are not exempt from mandatory disclosure pursuant to §1-210(b)(3), G.S.

 

35.    It is found, however, that in-camera record #s 2005-508/511-556 through 564 were compiled in connection with the detection or investigation of crime and contain the name and address of sexual assault victims. 

 

36.    It is concluded, therefore, that in-camera record #s 2005-508/511-556 through 564 are exempt from mandatory disclosure and the respondent did not violate the disclosure provisions of §1-210(a), G.S., when he denied the complainant’s request for them.

 

37.    The respondent also contended that in-camera record #s 2005-508/511-299, 306, 388 through 401, 427 through 431, 505 through 506, 552, 591, 621, 644, 665, 702 through 703, and 708 through 735, are exempt from mandatory disclosure pursuant to §1-214(b) and (c), G.S.

 

38.    It is found that §§1-214(b) and (c), G.S., do not provide an exemption to disclosure but rather provide the method by which a public agency may provide a public employee with notice of a request for, and an opportunity to object to, the disclosure of his personnel, medical or similar files.

 

39.    It is therefore concluded that the records described in paragraph 37, above, are not exempt from mandatory disclosure pursuant to §§1-214(b) and (c), G.S.

 

40.    The respondent contends that in-camera record #s 2005-508/511-299, 306, 388 through 401, 427 through 431, 505 through 506, 552, 556 through 564, 591, 621, 644, 665, 702 through 703, and 708 through 735, are exempt from disclosure pursuant to §1-217(a)(2), G.S.

 

41.    Section 1-217(a)(2), G.S., provides in relevant part that “no public agency may disclose, under the FOI Act, the residential address of . . . a sworn member of a municipal police department . . . .”

 

42.    It is found that in-camera record #s 2005-508/511-712, 714 through 716, 719, 723, and 726 contain the residential address of a retired sworn member of a municipal police department and therefore, §1-217(a)(2), G.S., prohibits disclosure.

 

43.    It is found, however, that in-camera record #s 2005-508/511-299, 306, 388 through 401, 427 through 431, 505 through 506, 552, 556 through 564, 591, 621, 644, 665, 702 through 703, and 708 through 711, 713, 717 through 718, 720 through 722, 724 through 725, and 727 through 735 do not contain the name and address of a sworn member of a municipal police department and therefore, §1-217(a)(2), G.S., does not bar disclosure.

 

44.    At the hearing on this matter, Daniel Britt, the subject of the records identified as in-camera records #s 2005-508/511-196 through 735, contended, through counsel, that the aforementioned in-camera records are exempt from disclosure pursuant to §1-210(b)(2), G.S., because disclosure of such records would constitute an invasion of his personal privacy within the meaning of that statute and cited Payne v. City of Danbury, 267 Conn. 669 (2004), in support of his contention.

 

45.    The issue in Payne, supra, was whether the FOI Act provides for a private right of action for invasion of privacy.  The Supreme Court affirmed the decision of the trial court which held that the Act does not.  

 

46.   Mr. Britt also contends that in-camera record #s 2005-508/511-708 through 724 are exempt from disclosure pursuant to §1-210(b)(3)(G), G.S., and cited Bona v. Freedom of Information Commission, 44 Conn. App. 622 (1997).  The respondent indicated in a post-hearing letter to the Commission that the records are “relevant to a criminal investigation regarding a use of narcotics complaint in 1988” against Mr. Britt “which investigation found insufficient probable cause to pursue criminal charges.”

 

47.    However, as already found in paragraphs 32 and 33, above, that while in-camera records #s 2005-508/511-708 through 724 are records of a law enforcement agency, such records were not compiled in connection with the detection or investigation of crime. 

 

48.    It is found that in-camera records #s 2005-508/511-708 through 724 are records that pertain to the BPD’s non-criminal internal affairs investigations of certain allegations against Mr. Britt when he was an officer and the administrative disposition of such investigation.

 

49.    Therefore, as already concluded in paragraph 34, above, in-camera record #s 2005-508/511-708 through 724 are not exempt from mandatory disclosure pursuant to §1-210(b)(3)(G), G.S.

 

50.    It is found that social security numbers are found throughout the in-camera records and it is concluded that, pursuant to longstanding Commission precedent, disclosure of social security numbers will not be ordered.

 

51.    Based on the forgoing, it is concluded that the respondent violated the disclosure provisions of §1-210(a), G.S., by failing to provide the complainant access to inspect in-camera record #s 2005-508/511-196 through 2005-508/511-735 with the exception of the in-camera records described in paragraphs 28, 35, 42 and 50, above.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      Within 30 days of the notice of final decision in this matter, the respondent shall provide the complainant with a copy of the in-camera records, free of charge.

2.      In complying with the order in paragraph 1, above, the respondent may redact:

a.       the addresses found in in-camera record #s 2005-508/511-712, 714 through 716, 719, 723, and 726 and wherever else found in the in-camera records;

b.      those portions of in-camera record #s 2005-508/511-556 through 564 that reveal the name and address of the victim of sexual assault;

c.       in-camera record #s 2005-508/511-702 through 703; and

d.      social security numbers wherever found in the in-camera records.

3.      Henceforth, the respondent shall strictly comply with the disclosure provisions of §§1-210(a) and 1-212(a), G.S.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
