FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was heard as a contested case on June 12, 2006, at which time the complainants and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  For purposes of hearing, this matter was consolidated with Docket #FIC 2006-092; Cecil Young and Patricia Nichols v. Health Director, City of Bridgeport.

            By letter dated and filed with the Commission on July 17, 2006, the complainants withdrew the complaint in this matter.  The Commission takes administrative notice of such letter. 

The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  Based on the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
