FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

 

            The above-captioned matter was heard as a contested case on December 19, 2005, at which time the complainants appeared, and presented testimony, exhibits and argument on the complaint.  The respondent failed to appear.  Subsequent to the hearing, the respondent moved to reopen the matter for the purpose of presenting evidence.  Such motion was granted and the reopened hearing was scheduled for August 10, 2006. 

 

By letter dated and filed August 9, 2006, the complainants withdrew their complaint in this matter.  The Commission takes administrative notice of such letter. 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  Based on the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
