The above-captioned matter was scheduled to be heard as a contested case on April 3, 2006, at which time the complainants and the respondent appeared and informed the Commission that they had reached the following settlement of the complaint in this matter.

 

1.  The respondent stipulated to the following: “The Madison Board of Police Commissioners acknowledges that Cynthia Baran was misled by the agenda of the January 12, 2006 special meeting of the [Police] Commission.  The [Police] Commission further acknowledges that others might have also been misled.  The [Police] Commission had no intention of surprising Ms. Baran or anyone else, because it believed in good faith [that] the ‘Election of Officers’ item of the agenda covered all issues related to an election.  To the extent practicable, the [Police] Commission will endeavor to issue agendas that more fully announce topics expected to be discussed.”

 

2.  In consideration of the stipulation described in paragraph 1, above, the complainants withdrew their complaint.  

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is hereby dismissed.

 

2.   The Commission commends the parties on reaching a non-litigated settlement of this matter.
