The above-captioned matter was heard as a contested case on April 6, 2006, at which time the complainant and the respondents appeared and stated on the record that they had reached a settlement immediately prior to the hearing.

 

The complainant stated that the respondents had delivered the requested records to him shortly before the hearing, but that he had had an adequate opportunity to inspect the records for completeness. Based upon his receipt of the requested records, the complainant stated that he wished to withdraw his complaint in this contested case.

 

            The following order by the Commission is recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is hereby dismissed.

 

2.   The Commission commends the parties on having reached a settlement without adjudication.
