FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was scheduled to be heard as a contested case on September 7, 2005, at which time the respondents appeared but the complainant failed to appear.  Counsel for the respondents represented to the hearing officer that the matter was largely resolved, and requested that the matter be put over in anticipation of a settlement of the complaint by agreement. 

 

No further communication was received from the parties concerning this complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is dismissed for failure to prosecute.
