The above-captioned matter was consolidated for hearing with Docket # FIC 2005-450, which is also captioned Marty Calderon v. Chief, Police Department, City of New Haven. The matters were heard as contested cases on January 13, 2006, at which time the complainant and the respondent appeared and presented exhibits and argument on the complaint.

 

Following this initial presentation of evidence, at the suggestion of the respondent and with the permission of the complainant, an informal conference was held without the presence of the hearing officer. As a result of this conference, the parties announced on the record to the hearing officer their agreement as follows:

 

1) The respondent will provide to the complainant by 5 p.m., January 13, 2006 copies of fifteen internal values and ethics files of the Police Department, City of New Haven, including file ## 006-96-C, 070-96-C, 134-95-I, 007-03-C, 030-03-C, 078-03-C, 113-03-I, 165-91-C, 053-03-C, 088-92-C, 055-99-C, 054-00-I, 132-04-I, 132-04-I, 117-03-C, and 007-93-I;

 

2) The respondent will waive copying charges for all records provided to the complainant pursuant to the terms of this agreement;

 

3) The respondent will allow the complainant to inspect records specified at items 3, 4 and 5 of Exhibit D in the record for a period of half a day on one day of each week, and records specified by the complainant will be provided to her;      

 

            4) The requested records pertaining to Officer Paul Cavalier (item 2 of Exhibit D) are no longer in existence; and

 

            5) The complainant’s request for records at item 1 of her August 30, 2005 request letter (Exhibit D) has been fully satisfied.

 

The Commission commends both the complainant and the respondent for reaching a settlement of this case.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
