The above-captioned matter was heard as a contested case on June 23, 2005, at which time the complainants and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  The respondent director provided notice of the proceedings in this matter to the subjects of the records at issue herein.  The only individual subject of the records to appear at the hearing in this matter was Leonard Aronow.  At the outset of the hearing, Mr. Aronow requested, and was granted, party status in this matter.  In addition, at the outset of the hearing, AFSCME, Local 3144, and AFSCME Local 884, requested, and were granted, party status.  The case caption has been amended accordingly.     

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent director is a public agency within the meaning of §1-200(1), G.S.

 

            2.  It is found that, by letter dated November 3, 2004, the complainants informed the respondent director that they were engaged in an active campaign for two bargaining units represented by AFSCME, and one bargaining unit represented by the Connecticut Independent Labor Union, and that, as such, they were entitled to equal access to the employees of such units.  It is also found that the complainants requested an up-to-date mailing list of all members of such units, and a list of current executive board officers.

 

3.  It is found that, by letter dated November 23, 2004, the respondent director denied the request described in paragraph 2, above, and informed the complainants that the mailing lists described in paragraph 2, above, would only be supplied upon a “showing of interest.”  

 

4.  It is found that, by letter dated December 7, 2004, the complainants informed the respondent director that the request described in paragraph 2, above, was made under the Freedom of Information [hereinafter “FOI”] Act.

 

5.  By letter dated and filed with the Commission on December 20, 2004, the complainants appealed to the Commission, alleging that the respondent director violated the FOI Act by denying them copies of the records described in paragraph 2, above.  

 

6.  Section 1-210(a), G.S., provides in relevant part that:

 

“[e]xcept as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to…receive a copy of such records in accordance with section 1-212…."  

 

7.  Section 1-212(a), G.S., provides in relevant part that: “[a]ny person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.” 

 

            8.  It is found that the respondent director does not maintain or keep on file the list of current executive board officers described in paragraph 2, above.  Accordingly, it is concluded that the respondent director did not violate §§1-210(a) and 1-212(a), G.S., by failing to provide the complainants with a copy of such document. 

 

9.   It is found that the respondent director keeps on file the mailing lists described in paragraph 2, above.  It is found that such records are public records within the meaning of §§1-210(a) and 1-212(a), G.S.   Hereinafter, the mailing lists will be referenced as “the requested records”. 

 

            10.  Although not citing to specific statutory language, the respondents contend that the Municipal Employees Relations Act, §§7-467 through 7-479, G.S., provides a basis to withhold the requested records from the complainants.  

 

11.  Section 7-467, G.S., defines “municipal employer” to mean: 

 

“…any political subdivision of the state, including any town, city, borough, district, district department of health, school board, housing authority or other authority established by law, a private nonprofit corporation which has a valid contract with any town, city, borough or district to extinguish fires and to protect its inhabitants from loss by fire, and any person or persons designated by the municipal employer to act in its interest in dealing with municipal employees”

 

12.  It is found that the City of New Haven is a “municipal employer” pursuant to §7-467, G.S.

 

13.  It is found that, prior to the hearing in this matter, a labor union filed a complaint with the state Labor Relations Board [hereinafter “the board”] against the city of New Haven, contending that any release of the requested records to the complainants would constitute unfair labor practice.  It is further found that the respondent director asked the board for a ruling as to whether release of the requested records to the complainants would constitute “bad faith” on the part of the respondent department.  At the hearing in this matter, such complaint and request were pending before the board. 

14.  The Municipal Employees Relations Act [hereinafter “MERA”], §§7-467 through 7-479, G.S., sets forth the rights and duties of municipal employers, employees, and representatives with respect to collective bargaining, the powers of the board, and the parameters of mediation by the state Board of Mediation and Arbitration.  

15.  Section 7-470, G.S., sets forth prohibited acts and provides in relevant part:

“…[m]unicipal employers or their representatives or agents are prohibited from: (1) Interfering, restraining or coercing employees in the exercise of the rights guaranteed in section 7-468; (2) dominating or interfering with the formation, existence or administration of any employee organization; (3) discharging or otherwise discriminating against an employee because he has signed or filed any affidavit, petition or complaint or given any information or testimony under sections 7-467 to 7-477, inclusive; (4) refusing to bargain collectively in good faith with an employee organization which has been designated in accordance with the provisions of said sections as the exclusive representative of employees in an appropriate unit; (5) refusing to discuss grievances with the representatives of an employee organization designated as the exclusive representative in an appropriate unit in accordance with the provisions of said sections; (6) refusing to comply with a grievance settlement, or arbitration settlement, or a valid award or decision of an arbitration panel or arbitrator rendered in accordance with the provisions of section 7-472.”

            16.  It is concluded that no provision of MERA, including §7-470, G.S., provides an exemption to withhold the requested records from the complainants.

 

17.  The respondents cite to a 1978 decision of the board, Decision No.1682, In the Matter of State of Connecticut and International Union of Operating Engineers and Connecticut State Employees Association, (September 20, 1978).  The board noted therein that furnishing a mailing list of employees to one requesting union might be considered a prohibited practice, and concluded that MERA does not require a municipal employer to provide the mailing lists of employees to unions for use in an organizational campaign unless the requesting unions make a showing of interest.  

 

18.  It is concluded, however, that the FOI Act does require that the respondents provide the complainants with copies of the requested records absent proof that an exemption applies. 

 

19.  The respondents also contend that they are prohibited from disclosing certain requested records by operation of §1-214(c), G.S.

           

20.   Section 1-214(b), G.S., in relevant part states:

 

“[w]henever a public agency receives a request to inspect or copy records contained in any of its employees' personnel or medical files and similar files and the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy, the agency shall immediately notify in writing (1) each employee concerned, provided such notice shall not be required to be in writing where impractical due to the large number of employees concerned and (2) the collective bargaining representative, if any, of each employee concerned….”                    

                                                                                               

21.  Section 1-214(c), G.S., in relevant part states:

 

“[a] public agency which has provided notice under subsection (b) of this section shall disclose the records requested unless it receives a written objection from the employee concerned or the employee's collective bargaining representative, if any, within seven business days from the receipt by the employee or such collective bargaining …Upon the filing of an objection as provided in this subsection, the agency shall not disclose the requested records unless ordered to do so by the Freedom of Information Commission pursuant to section 1-206….” 

 

22.  It is found that the respondent director notified the subjects of the requested records, of the request described in paragraph 2, above, by letter dated January 13, 2005, and that the respondent director notified the subjects of the requested records, of the proceedings in this matter, by letter dated June 16, 2005. 

 

23.  There is no evidence in the record to indicate that the collective bargaining representatives of any subject employees filed written objections to disclosure as mandated by §1-214(b), G.S.  It is found that four individuals who are subjects of the requested records, namely Elaine Braffman, Carol Casanova, Donna Hall, and Charles Wailonis, filed objections to disclosure with the respondent director, but that none of these individuals appeared at the hearing in this matter.  As stated in the opening paragraph, Leonard Aronow, another subject of the records appeared at the hearing in this matter and was made a party. 

           

24.  At the hearing in this matter, the complainants withdrew their request for the records insofar as they relate to Mr. Wailonis and Mr. Aronow.  Accordingly, paragraph one of the order, below, does not apply to the residential addresses of Mr. Wailonis and Mr. Aronow.

 

25.  Section 1-210(b)(2), G.S., in relevant part provides for the nondisclosure of "personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy."

 

26.  The Supreme Court set forth the test for the §1-210(b)(2), G.S., exemption in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993), which test has been the standard for disclosure of records pursuant to that exemption since 1993.  The Commission takes administrative notice of the multitude of court rulings, Commission final decisions (see Endnotes1) and instances of advice given by Commission staff members (see Endnotes2) which have relied upon the Perkins test, since its release in 1993.

 

27.  Specifically, under the Perkins test, the claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: that the information sought does not pertain to legitimate matters of public concern, and such information is highly offensive to a reasonable person.

 

28.  It is found that the requested records constitute  “personnel” files within the meaning of §1-210(b)(2), G.S.   

 

29.  It is further found that the respondents failed to prove that disclosure of the requested records would constitute an invasion of personal privacy within the meaning of §1-210(b)(2), G.S.   Accordingly, it is concluded that the requested records are not exempt from disclosure by virtue of §1-210(b)(2), G.S.

 

30.  The Commission takes administrative notice of §1-217, G.S., which provides:   

 

“(a)  No public agency may disclose, under the Freedom of Information Act, the residential address of any of the following persons:

 

(1)  A federal court judge, federal court magistrate, judge of the Superior Court, Appellate Court or Supreme Court of the state, or family support magistrate;

 

(2)  A sworn member of a municipal police department or a sworn member of the Division of State Police within the Department of Public Safety;

 

(3)  An employee of the Department of Correction;

 

(4)  An attorney-at-law who represents or has represented the state in a criminal prosecution;

 

(5)  An attorney-at-law who is or has been employed by the Public Defender Services Division or a social worker who is employed by the Public Defender Services Division;

 

(6)  An inspector employed by the Division of Criminal Justice;

 

(7)  A firefighter;

 

(8)  An employee of the Department of Children and Families; or

 

(9)  A member or employee of the Board of Parole;

 

(10) An employee of the judicial branch; or

 

(11) A member or employee of the Commission on Human Rights and Opportunities.

 

(b)  The business address of any person described in this section shall be subject to disclosure under section 1-210.  The provisions of this section shall not apply to Department of Motor Vehicles records described in section 14-10.”

 

31.  It is found that the subject Donna Hall is the spouse of the assistant U.S. Attorney for the District of Connecticut, who is the deputy chief of the Organized Crime Drug Enforcement Task Force.  The Commission in its discretion declines to order the disclosure of Ms. Hall’s residential address.

 

32.  The Commission notes that the sworn objection of Elaine Braffman asserts that she has a restraining order protecting her person, and that the sworn objection of Carol Casanova asserts that she is the victim of stalking. 

 

33.  The Commission takes administrative notice of §1-210(b)(21), G.S., which exempts from mandatory disclosure “the residential, work or school address of any participant in the address confidentiality program established pursuant to sections 1 to 16, inclusive, of P.A. 03-200.”  

34.  Public Act 03-200 established an address confidentiality program, administered by the Secretary of the State, whereby any person who has been a victim of family violence, injury or risk of injury to a child, sexual assault or stalking, may keep their residential and work address confidential.

35.  The Commission in its discretion declines to order the disclosure of Ms. Braffman’s and Ms. Casanova’s addresses.

 

36.  It is concluded that the respondent director violated the FOI Act, by failing to provide the complainants with copies of the requested records, except those portions of the requested records, which may be exempt by virtue of §§1-210(b)(21), and 1-217, G.S.

 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  Forthwith, the respondent director shall provide the complainants with a copy of the requested records, except for records regarding Leonard Aronow and Charles Wailonis. 

 

2.  In complying with paragraph 1 of the order, the respondent director shall withhold the residential and business addresses of Elaine Braffman and Carol Casanova.

 

3.  In complying with paragraph 1 of the order, the respondents shall withhold the residential and business addresses of any individuals whose residential and business addresses are exempt by virtue of §1-210(b)(21), G.S.

 

4.  In complying with paragraph 1 of the order, the respondent director shall withhold the residential address of Donna Hall, and shall instead provide the complainants with her business address.

 

5.  In complying with paragraph 1 of the order, the respondents shall withhold the residential addresses of any individuals whose residential addresses are exempt by virtue of §1-217, G.S., and shall instead provide the complainants with such individuals’ business addresses.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
