The above-captioned matter was scheduled to be heard as a contested case on September 19, 2005, at which time the complainant and the respondent appeared and informed the Commission of the terms of an agreement they reached in resolution of the complaint.  The understanding of the parties and the Hearing Officer in this matter is that:

 

a)                          With respect to item one of the complainant’s records request dated June 17, 2005, the respondent agreed to provide the complainant with a copy of all records responsive to such request on or before September 23, 2005 and upon receipt of the complainant’s payment for copies of such records as well as an outstanding balance in connection with a prior Freedom of Information (“FOI”) Act request; 

b)                          With respect to item two of the complainant’s records request dated June 17, 2005, the respondent represented that all records responsive to such request were previously provided to the complainant in connection with a prior FOI request;

c)                          Based on the above, the complainant withdrew the complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  The complaint is hereby dismissed.
