The above-captioned matter was scheduled to be heard on August 17, 2005, at which time the respondents appeared, however, the complainant failed to appear to prosecute the complaint.  For purposes of hearing, the following matters were consolidated with the above-captioned case: contested case docket #FIC 2005-223, Bradshaw Smith v. The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  The complaint is hereby dismissed for failure to prosecute.
