The above-captioned matter was scheduled to be heard as a contested case on June 21, 2005, at which time the complainants and the respondent appeared, and requested a continuance so that they could attempt settlement of the complaint.  Such continuance was granted.   By letter received at the Commission on August 2, 2005, the complainants informed the Commission that the parties had reached an agreement in resolution of the complaint.  The complainants further informed the Commission that they wished to withdraw the complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  Based on the above-described agreement, reached by the parties in this matter, and the withdrawal of the complaint, the case is hereby dismissed.
