The above-captioned matter was scheduled to be heard as a contested case on July 15, 2005, at which time the complainant and the respondent appeared and informed the Commission that they had reached an agreement in resolution of the complaint.  The complainant then informed the Commission that he wished to withdraw the complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  Based on the agreement of the parties in this matter, and the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
