The above-captioned matter was heard as a contested case on November 18, 2004, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. At the conclusion of the hearing, the parties agreed to a settlement of the complaint, pursuant to which the respondent acknowledged that it should have responded to the complainant’s request within four business days, and that the complainant was entitled to receive copies of the requested records. The respondent agreed to provide the complainant with the records that it had found, and the complainant agreed to withdraw his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
