The above-captioned matter was scheduled to be heard as a contested case on February 14, 2005, at which time the complainant and the respondent appeared. For purposes of hearing, this matter was consolidated with Docket# FIC 2004-358; Wayne C. Gerlt v. Town Council, Town of South Windsor. At the outset of the hearing, the complainant informed the Commission that he wished to withdraw this complaint, as it is a duplicate of the complaint in Docket #FIC2004-358.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
