The above-captioned matter was heard as a contested case on April 14, 2005, at which time the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.

 

Following the presentation of evidence, with the permission of the parties, an informal conference was held. As a result of this conference, and based upon the sworn testimony received, the complainant agreed to withdraw her complaint in this contested case.

 

            The Commission commends both the complainant and the respondent for reaching a settlement of this case.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
