            The above-captioned matter was scheduled to be heard as a contested case on February 15, 2005, at which time the complainant and the respondent appeared.  During an off-the-record conference the respondent provided the complainant with copies of records responsive to her September 23, 2004 request.  The respondent advised the complainant at that time that a misunderstanding had occurred and that she believed that the records had previously been provided to the complainant.   Based upon the respondent’s representation and the provision of the requested records, the complainant indicated that she wished to withdraw her complaint.

 

               The following order by the Commission is hereby recommended on the basis of 
the record concerning the above-captioned complaint:
               
1.      The complaint is hereby dismissed.
