The above-captioned matter was heard as a contested case on November 16, 2004, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 

 

After hearing the testimony of the respondent, the complainant stated that he wished to withdraw his complaint.  The Commission commends the parties for resolving this matter and credits the complainant for his practical reasoning. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  The complaint is hereby dismissed without prejudice.
