The above-captioned matter was scheduled to be heard as a contested case on September 29, 2004, at which time the complainants and the respondent appeared to present testimony, exhibits and argument on the complaint. However, shortly after the hearing was opened, an informal conference was held with the permission of the parties. At this conference, the complainants and the respondent agreed on a framework for the resolution of this contested case.
On November 3, 2004, the individual complainant informed the Commission that he had “received the information that I requested” and withdrew the complaint.
The Commission warmly commends both the complainants and the respondent for an intelligent, practical approach to the disclosure and security interests implicated by a request for various records concerning the renovation and expansion of the Hartford Correctional Center.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
