The above-captioned matter was heard as a contested case on November 1, 2004, at which time the complainants and the respondent appeared and informed the Commission that they reached an agreement in resolution of the complaint.  The complainants then withdrew the complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  Based on the above-described agreement, reached by the parties in this matter, and the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
