The above-captioned matter was heard as a contested case on June 7, 2004, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. During the course of the hearing, the parties reached the terms of a settlement as set forth below:
the respondent provided the complainant with the names of the police officers, which are the records at issue in this matter, and the complainant indicated that he no longer wished to pursue his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
2. The Commission commends the parties for resolving this matter.
