FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was heard as a contested case on April 5, 2004, at which time the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.  During the hearing, counsel for the respondent represented that to the best of her knowledge the records requested by the complainant, that do exist, are not exempt from disclosure and should therefore, be provided to the complainant.  The parties agreed that counsel for the respondent should have an opportunity until April 12, 2004, to fully review all appropriate files and report back to the Commission and to the complainant as to whether a) all records located would be provided to the complainant, and b) whether any records located would be claimed as exempt from disclosure.  On April 12, 2004, counsel for the respondent filed an affidavit with the Commission.  Such affidavit is attached to this report and the entire contents are incorporated herein, and made a part of this report.   

           

Based on the foregoing, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  In light of the representations described herein, the complaint is hereby dismissed.
