The above-captioned matter was scheduled for hearing as a contested case on April 26, 2004, at which time the complainant and the respondent appeared to present testimony, exhibits and argument on the complaint. However, shortly after the hearing was opened, with the permission of the parties, an informal conference was held.
As a result of this conference, the respondent agreed to work with the complainant and to meet with her as reasonably needed to address her requests for non-exempt records. Specifically, the respondent agreed to provide the complainant with nine notices of expulsion hearings issued by the respondent on March 25, 2003 and April 15, 2003, with the names of students redacted. Based upon this commitment, the complainant agreed to withdraw her complaint in this contested case.
The Commission warmly commends the complainant and the respondent for reaching a non-litigated settlement of this case.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
