            The above-captioned matter was scheduled for hearing as a contested case on March 25, 2004, at which time the complainant and the respondent appeared to present testimony, exhibits and argument on the complaint. However, shortly after the hearing was opened, with the permission of the parties, an informal conference was held. As a result of this conference, the complainant agreed to withdraw this contested case.

 

            The Commission warmly commends the complainant for reaching the decision that allowed a non-litigated settlement of this case.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
