The
above-captioned matter was scheduled to be heard as a contested case on
February 24, 2004, at which time the complainant and the respondent appeared
and indicated to the Commission that they resolved their earlier differences
and there was no need for a hearing because the record at issue would be
provided to the complainant as soon as the respondent received his check.
The complainant then withdrew his complaint.
For purposes of hearing, contested case docket # FIC 2003-377, Joseph
R. Casey, Jr. v. Commissioner, State of Connecticut, Department of Correction,
was consolidated with the above-captioned case.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the above, the complaint is dismissed.
2. The Commission commends the parties on having reached a resolution in this matter without the need for a hearing.
