            The above-captioned matter was scheduled to be heard as a contested case on August 6, 2003, at which time the complainant and the respondents appeared and reached the following terms, in resolution of this case:

 

1.  The respondents have substantially complied with the complainant’s request for copies of voluminous records.

 

2.  The complainant shall review the copies most recently received from the respondents to determine if they are complete.

 

3.  In the event that the copies described in paragraph 2, above, are incomplete, the respondents shall work with the complainant to provide any further copies that were inadvertently omitted.  

 

4.  The complainant is not prevented from making subsequent records requests of the respondents, nor is he prevented from filing subsequent appeals with this Commission.

 

5.  In consideration of the foregoing, the complainant withdrew the complaint in this matter. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

 

            1.  The complaint is hereby dismissed without prejudice.

 

            2.  The Commission commends all parties for reaching a non-litigated settlement of this matter.
