The above-captioned matter was heard as a contested case on June 10, 2003, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. At the conclusion of the hearing, the parties reached a stipulated agreement in settlement of the complaint. The parties agreed that:
1. The respondents will search for and provide to the complainant a copy of the SNET license agreement as it existed as of January 1, 1998 for pay telephones along the railroad right of way, together with the pay telephone locations, with any proprietary information redacted.
2. The complainant will withdraw its complaint.
3. If the records identified in paragraph 1, above, are not satisfactory to the complainant, the complainant will make a new request for information, identifying the particular records sought, and addressed to the specific custodian of those records.
4. In the event the complainant needs to make a new request, the respondents will provide to the complainant the specific office or individual to whom the request should be made.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
