The above-captioned matter was heard on November 19,
2002, at which time the complainant and the respondents appeared and presented
testimony, exhibits and argument on the complaint.
Pursuant to an agreement reached prior to the hearing
on this matter, the respondents’ witness, the assistant personnel
administrator for the State of Connecticut, Department of Transportation,
testified under oath that the record at issue was never generated and
therefore does not exist, following which the complainant indicated that he
wished to withdraw his complaint. The
Commission commends the parties for their efforts in resolving this matter.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
