The above-captioned matter was scheduled to be heard as a contested case on December 6, 2002, at which time the complainant and respondent appeared and informed the Commission that they had reached the terms of an agreement in settlement of this matter.  Accordingly, the complainant withdrew his complaint.    

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.

 

            2.  The Commission commends the parties for reaching a non-litigated settlement of this matter.
