            The above-captioned matter was scheduled to be heard as a contested case on November 4, 2002, at which time the complainant and the respondents appeared to present testimony, exhibits and argument on the complaint. At an informal conference prior to the November 4, 2002 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case.

 

Pursuant to the terms of this agreement, the respondents agreed to provide to the complainant, within ten days and without charge to the complainant, a copy of their entire file for their “Transition to Teaching” grant program. Based upon the promise to provide him with a copy of this file, the complainant agreed to withdraw his complaint.

 

            The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-adversarial settlement of this case. Both parties demonstrated good faith.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
