The above-captioned matter was heard as a contested case on January 25, 2002, at which time the complainant appeared, and presented testimony, exhibits and argument on the complaint.  The respondent failed to appear at the January 25, 2002 hearing. 

 

            Following the hearing in this matter, the complainant informed the Commission, by letter dated January 30, 2002, and filed on January 31, 2002, that he is withdrawing his complaint in light of the fact that the respondent provided him with the record he was seeking.

           

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is dismissed.
