The above-captioned matter was heard as a contested case on October 23, 2002, at which time the complainant and respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  At such time, the complainant withdrew his complaint when it became evident that the respondent does not maintain or keep on file the records at issue herein. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.

 

            2.  The Commission commends both parties for reaching a non-litigated settlement of this matter.
