The above-captioned matter was scheduled to be heard as a contested case on August 14 and September 20, 2001, and February 11, 2002, at which times the complainants and the respondent appeared and indicated to the Hearing Officer that they had arrived at an agreement in resolution of the complaint.  On April 8, 2002 complainant Tegeler informed the clerk of the Commission by telephone that the respondent provided him with the requested records and that a hearing on this matter would therefore not be necessary.

 

Based on the foregoing, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  The complaint is hereby dismissed.
