Following remand by the court, Cohn, J., CV 01-0510696-S (A65), the above-captioned matter was scheduled to be heard as a contested case on April 16, 2002.  However, by letter dated April 1, 2002 and filed with the Commission on April 3, 2002, the complainant requested that this case be dismissed as he does not intend to further prosecute this matter.

           

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  The complaint is hereby dismissed.
