The above-captioned matter was heard as a contested case on December 11, 2001, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  During the hearing, the parties, with the assistance of the Hearing Officer, agreed to try to resolve their differences outside of the context of a contested case, and further that the complainant would thereafter inform the Commission whether he wished to withdraw his complaint or if a further hearing would be necessary.  On March 13, 2002, the complainant informed the Commission that he wished to withdraw the complaint. 

           

Consequently, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      In light of the above, the matter is hereby dismissed.
