            The above-captioned matter was scheduled to be heard as a contested case on September 28, 2001, at which time the complainant and the respondent appeared, and informed the Commission that they had arrived at the following settlement in resolution of the complaint: the respondent’s counsel will provide to the complainant, in approximately three weeks, all documents that are responsive to the complainant’s request.  In light of the agreement described herein, the complainant agreed to withdraw his complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  The complaint is dismissed.
