            The above-captioned matter was scheduled to be heard as a contested case on August 6, 2001, at which time the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.

 

            During the August 6, 2001 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case.  Under the terms of such agreement, the respondent provided the complainant at the hearing with copies of certain contracts that were partially responsive to his requests on June 6, 2001.  In addition, the respondent agreed to provide copies of the following records to the complainant, by 3:00 p.m. on August 7, 2001, at the office of the respondent:  the current secretary’s contract, the current accountant’s resume (with redaction of home address and social security number only), if the respondent maintains such resume; and an invoice or invoices from The New Haven Register, indicating dates on which advertisements appeared for the positions of accountant, attorney and secretary.   The respondent further agreed that if it did not maintain a copy of the secretary’s resume, it would inform the complainant in writing of such fact, on August 7, 2001.  Based upon the parties’ agreement, the complainant stated that he wished to withdraw his complaint.

 

            The Commission commends the parties for ultimately negotiating an agreement in resolution of this case.  However, this matter could have easily been resolved at an earlier date, if both parties had been willing to communicate in a more timely and reasonable manner.  The Commission therefore strongly encourages both parties to work toward resolution of any similar future disputes at a much earlier juncture and to thereby avoid the waste of valuable state time and resources.  

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
