		Respondents	July 11, 2001

            The above-captioned matter was heard as a contested case on November 8, 2000, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  The records at issue were reviewed in camera.  The Hearing Officer issued a report dated May 2, 2001, which was submitted to the Commission for consideration at its June 13, 2001 regular meeting.  At that time, counsel for the respondents appeared and requested that the matter be tabled to the Commission’s June 27, 2001 regular meeting, to facilitate a withdrawal of the complaint because the parties had arrived at a settlement resolving their earlier differences.  The matter was considered at the June 27, 2001 meeting and tabled again following a further request by counsel for the respondents.  By letter dated July 8, 2001, and filed with the Commission on July 9, 2001, the complainant informed the Commission that he wished to withdraw the complaint because he and the respondents had arrived at a settlement in this matter.  Based on the complainant’s request, the Hearing Officer withdrew the May 2, 2001 Hearing Officer’s Report and issued this report in lieu thereof.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is hereby dismissed.
