              The above-captioned matter was scheduled to be heard as a contested case on January 9, 2001, at which time the complainants and the respondent appeared.  At such time, Sodexho Marriott Management, Inc., requested, and was granted, intervener status.  The parties and the intervener jointly requested that the matter be continued so that settlement of the complaint might be attempted.  Such request was granted and the matter was continued to March 28, 2001.  By letter dated March 23, 2001, the complainants informed the Commission that the parties reached settlement of the matter, and filed a motion to withdraw the complaint executed by the complainants, the respondent, and the intervener.  Accordingly, the March 28, 2001, continued hearing was cancelled. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.

 

            2.  The Commission commends the parties and intervener for reaching a non-litigated settlement of this matter.
