The above-captioned matter was scheduled to be heard as a contested case on February 15, 2001, at which time the complainant and the respondents appeared and presented exhibits on the complaint.  However, during a recess of the hearing, the respondents provided the complainant with the records at issue.  Thereafter, the complainant informed the Commission that he wished to withdraw his complaint.

   

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

1.      The complaint is hereby dismissed.

 

2.   The Commission commends the parties for settling the matter without a hearing.
