            The above-captioned matter was scheduled to be heard as a contested case on January 30, 2001, at which time the complainant and the respondents appeared, and arrived at an agreement in resolution of the complaint.  Specifically, the parties agreed that the respondents will provide to the complainant redacted copies of the forms maintained by the respondents that are responsive to her request of October 25, 2000.  The redactions will be as follows:

 

a.  With respect to the forms concerning all students except those identified in complainant’s exhibits C and D, such forms will be provided with redactions to the names and dates of birth;

b.  With respect to the forms concerning all students identified in complainant’s exhibits C and D, such forms will be provided with redactions to the names, dates of birth, ethnicity and grade.

 

            Based upon the agreement, the complainant withdrew the complaint.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is dismissed.

 

2.  The Commission commends the parties on having reached a settlement in resolution of the complaint.
