The above-captioned matter was scheduled to be heard as a contested case on October 4, 2000, at which time the respondent appeared but the complainant failed to appear.  For purposes of hearing, the above-caption complaint was consolidated with docket #s FIC2000-378, Evelyn V. Russo v. Charter Revision Commission, City of Middletown; FIC 2000-379, V. James Russo v. Charter Revision Commission, City of Middletown; FIC2000-380, Joseph E. Milardo, Jr. v. Charter Revision Commission, City of Middletown; FIC2000-382, Andrew Rak v. Charter Revision Commission, City of Middletown; and FIC 2000-383, David Roane v. Charter Revision Commission, City of Middletown.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

1.      The complaint is hereby dismissed, with prejudice, for failure to prosecute.

 

2.      The Commission takes notice of the facts set forth in paragraph 2 of docket #s FIC 2000-378, FIC 2000-379, FIC 2000-380 and that the complainant’s appeal in this matter is almost identical to the appeals in those cases.  The Commission strongly admonishes the complainant for his failure to notify the Commission that he did not intend to prosecute his complaint, which failure resulted in the waste of valuable and scarce state resources.
