The above-captioned matter was heard as a contested case on September 12, 2000, at which time the complainants appeared and presented testimony on the complaint. The respondent failed to appear. During the course of the hearing, the complainants withdrew their complaint when it became apparent that the Commission lacked subject matter jurisdiction in this matter.
The following order by the Commission is hereby recommended on the basis of
the record concerning the above-captioned complaint:
1. The Commission commends the complainants for withdrawing their complaint at the initiation of the hearing in this matter, thereby avoiding misuse of the Commission’s scarce resources.
2. The complaint is dismissed.
