The above-captioned matter was scheduled to be heard as a contested case on September 15, 2000, at which time neither the complainant nor the respondent appeared.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

1.      The complaint is hereby dismissed with prejudice for failure to prosecute.

 

2.      The Commission admonishes the complainant for his failure to notify the Commission of his intent not to prosecute his complaint, which resulted in the waste of valuable and scarce state resources.
