            The above-captioned matter was heard as a contested case on July 27, 2000,  at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondent is a public agency within the meaning of §1-200(1), G.S.

 

2.  By letter dated June 22, 2000, and filed with the Commission on June 28, 2000, the complainant alleged that the respondent violated the Freedom of Information [hereinafter “FOI”] Act by failing to take votes to set the time and place of several public hearings of the respondent which were held throughout 1999 and 2000.  At the hearing in this matter, the complainant reiterated such allegation.

 

3.  It is concluded that the complainant has not alleged any conduct on the part of the respondent that constitutes a violation of the FOI Act.

           

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is hereby dismissed.
